  5. RetSquid says:

There are a handful of people who have avoided criminal (but not civil) penalties by convincing a jury that they were too stupid or delusional to understand the tax laws and their violations were not “willful,” but no one has ever won against the IRS in a tax collection case using? one of the frivolous argument[s] described in this video

  6. prof5string says:

They were acquitted on criminal charges because the jury bought their claim that they sincerely believed they didn’t have to file or pay taxes, thereby negating the element of willfullness that was part of the offense they were charged with.? But their acquittals had no effect on their civil liability, and they still owed the taxes. For example, Cryer’s estate (he died after filing suit in Tax Court) was held liable for back taxes, penalties, and interest.

Then why has Attourney Tom? Cryer, IRS Agent Joe Banister, IRS Agent Sherry Jackson, and may others won in court?

  9. omni crunk says:

Sherry? Peel Jackson is soo sexy and fine.

  10. RetSquid says:

Section 6151 requires you to pay income tax, QED you cannot use it to prove you are not required to pay income? taxes. Not a single person has won in court claiming there is no law that requires payment of income tax.

  11. wulfmanUNCP says:

Just curious what part of 6151? invalidates it. Read it, not sure I understand.

I doubt very seriously if that’s what happened. More likely is that the jury bought? the guy’s story that he sincerely believed he didn’t have to pay taxes, thereby negating the element of willfullness. But an acquittal on criminal charges doesn’t mean he doesn’t owe the taxes — Tommy Cryer was acquitted, yet after he died his estate was found liable for tax deficiencies.

  21. Jerry Alexander says:

Simiprof5string…you are dead wrong.A man in CA was? set free because the jury ask the judge to show them the law that said one mush pay taxes on Income..he could not.The man was was found innocent on all charges of Income fraud.

  24. RetSquid says:

“because it did not hold up in court but? still does not mean its right”

Actually, that is EXACTLY what it means, the court said it is wrong therefore it? is wrong.
